General Terms and Conditions of Innsbrucker Festwochen der Alten Musik GmbH (including Meister- und Kammerkonzerte)

SCOPE
By purchasing your ticket, gift voucher or subscription, as well as by attending an event organised by Innsbrucker Festwochen der Alten Musik GmbH (hereinafter referred to as ‘Festwochen’) (even if free of charge), you expressly agree to the validity of and compliance with these General Terms and Conditions (hereinafter referred to as ‘GTC’). The GTC govern the legal relationship between customers on the one hand and the Festwochen on the other and form an integral part of all contracts between them. In the event of a ticket being passed on, it is the responsibility of the previous purchaser to point out that the GTC apply to any subsequent purchaser. The GTC and our prices can also be found at the ticket office of the Haus der Musik Innsbruck (HDM), at the Festwochen office and on the Internet. The Festwochen may amend these GTC or replace them with new ones. The version of the GTC valid at the time of conclusion of the contract on the homepage shall be authoritative.
ADMISSION
The purchase of a ticket entitles the holder to admission to the performance on the day of the performance. Visitors are obliged to carry their ticket with them for the duration of the performance and to present it to the admission staff on request.
Depending on the venue, admission usually begins 45 minutes before the start of the event. For safety reasons and out of consideration for the performers and other visitors, the right to the booked seat expires at the start of the event. After the performance has begun, visitors may only be admitted to the auditorium during a suitable interval. The instructions of the staff must be followed in this regard. Unauthorised entry into the auditorium constitutes a violation of the house rules, which may result in expulsion from the venue and, in more serious cases, a ban from the premises.
CLOAKROOM
The cloakroom is free of charge for Meister- und Kammerkonzerte as well as Festwochen, provided that a cloakroom is available at the respective venue. Coats, umbrellas, large bags, rucksacks, similarly bulky items and image recording devices must be handed in to the cloakroom staff. Due to the special features of some historic venues, a cloakroom service cannot be guaranteed for all events.
Upon issuing a cloakroom ticket, the Festwochen is only liable for loss or damage to stored items if the cloakroom staff has intentionally or negligently violated its storage obligations. Liability is limited to the current value of all items handed in on a cloakroom ticket and amounts to a maximum of €550. ID cards and documents of all kinds, credit cards, cash, keys and valuables such as jewellery, electronic devices, etc. are excluded from liability, especially if these items are in coat pockets or containers. The loss or damage of cloakroom items and the loss of a cloakroom ticket must be reported immediately to the cloakroom staff. Cloakroom items may only be handed over without a cloakroom ticket if it can be credibly demonstrated that the visitor is the rightful recipient. In the event of loss of the cloakroom ticket, an appropriate monetary compensation may be demanded.
TICKET SALES
Online sales
Tickets can be booked directly in the seating plan at www.altemusik.at and www.meisterkammerkonzerte.at. With online sales, print@home tickets can be conveniently printed at home or saved as e-tickets, but subscriptions cannot be redeemed. Print@home tickets cannot be returned and no subsequent discounts can be given on tickets that have already been paid for. We offer postal delivery of ordered tickets for a fee of €3. In addition, tickets that have already been paid for can be collected from the ticket office at the Haus der Musik Innsbruck and the evening ticket office at the respective event venue. Tickets purchased via the ‘Ticket Gretchen App’ are subject to the terms and conditions of Ticket Gretchen GmbH (https://ticketgretchen.com/partner-agb/).
Written orders
Ticket orders can be placed from the start of advance ticket sales. Written orders by e-mail or letter will be processed after the start of advance sales.
Reservation periods
Reservations are generally valid for 14 days from receipt of the reservation confirmation, but at the earliest from the start of advance sales. From one month before the performance, this period is reduced to five working days. In the last week before an event, reserved and unpaid tickets must be collected and paid for within one day. Ticket reservations for performances on the same day are not possible.
Payment options
Cashless payment by credit card and debit card is possible at the advance sales offices and at the evening/day box office. Online ticket purchases can be paid for by credit card or online banking (instant transfer). The respective payment terms of the advance sales office or the evening/day box office, which accepts credit cards, apply.
Ticket prices
The prices for seated and standing places are based on the applicable price lists. All prices include the statutory value added tax and any advance booking fees. The Festwochen reserves the right to set different prices in individual cases (especially for special events and the like). Ticket prices for subscriptions are based on the applicable subscription conditions. There is no legal entitlement to discounts, specific tickets or ticket categories.
Terms of payment
Unless otherwise agreed, visitors are obliged to pay the agreed fee immediately, but no later than within 14 days. In the event of late or incomplete payment, the Festwochen reserves the right to cancel the tickets and to retain ownership of the delivered tickets until full payment has been received.
Discounts
Discounts for Festwochen events and Meister- und Kammerkonzerte:
Multiple discounts cannot be combined. Discounts cannot be combined with subscriptions. All discounts are only granted upon presentation of valid photo ID. Valid proof of eligibility for discounts must be presented unsolicited at the box office and at the entrance. In the event of violations, the difference will be charged retrospectively. Special events (in particular children's events, workshops, lectures, etc.) are excluded from the discount.
Services
A ticket also offers the following services: It is also valid as a ticket for public transport in the Innsbruck core zone 2 hours before and after the event. The general fare regulations and conditions of carriage of Innsbrucker Verkehrsbetriebe and Stubaitalbahn GmbH apply. There is also a free shuttle from the city centre to the evening concerts at Schloss Ambras.

Data required for the processing of the contractual relationship is collected from visitors.
TICKET EXCHANGE
Purchased tickets, regardless of whether they were purchased online, at the box office or advance sales point, or printed as print@home tickets, cannot be returned or exchanged without exception.
TICKET RETURNS
Ticket orders and purchases are binding in any form and, in accordance with the existing regulations, oblige the purchaser to accept and pay for the tickets ordered. No replacement will be provided for expired tickets. You may only withdraw from this order in accordance with the limited legal provisions (ABGB, KSchG), for example if you were misled when placing the order or if the order was placed under duress. Ticket orders are not subject to the Distance and Off-Premises Sales Act (§ 18 (1) Z 10 FAGG), which means that a seven-day right of withdrawal and return for services in the area of leisure activities is excluded if a specific time or period is contractually stipulated for the fulfilment of the contract by the entrepreneur. LOST TICKETS
If a ticket is lost, the Festwochen can issue a replacement ticket, provided that the purchaser can prove or credibly demonstrate which ticket they had purchased by specifying the exact seat number. If both the original ticket and a replacement ticket for the same seat are presented by different visitors, the holder of the replacement ticket shall take precedence over the holder of the original ticket. In this case, the original ticket does not entitle the holder to be allocated another seat. The admission staff will not check whether the ticket holder is the rightful owner. Booking under the respective customer number (personalised ticket purchase) facilitates the allocation of replacement tickets.
VOUCHERS
Vouchers can be purchased and redeemed at the ticket office in the Haus der Musik Innsbruck and online in the web shop. Vouchers cannot be purchased or redeemed at the Festwochen box office. Vouchers cannot be exchanged for cash and cannot be used to purchase other vouchers. Vouchers cannot be returned, cancelled or exchanged. The right of withdrawal for consumers who have purchased vouchers via distance selling remains unaffected. By purchasing a voucher, the visitor accepts the organiser's general terms and conditions and the applicable house rules. The resale of vouchers is prohibited. The Festwochen reserves the right to block customers from purchasing vouchers and redeeming resold vouchers in the event of non-compliance.
Redeeming at the box office
When paying for tickets with a voucher at the box office, the original voucher must be presented. If the value of the voucher exceeds the purchase price, the customer will receive a new voucher for the remaining amount after deduction of the respective purchase price.
Online redemption
When paying for tickets with a voucher in the online shop, the 8-digit voucher code must be entered. For technical reasons, the voucher code is only valid for one year, so vouchers can only be redeemed in the online shop during the first year after purchase. For the remaining period of validity, the customer can redeem the voucher at the ticket office.
Right of withdrawal for vouchers
When purchasing vouchers by telephone, e-mail or on the Internet, the purchaser, provided they are a consumer, has the right to withdraw from the contract within fourteen days of conclusion of the contract without giving reasons. To exercise this right of withdrawal, the buyer must inform Festwochen of their decision to withdraw from the purchase contract for the voucher by means of a clear statement (e.g. a letter sent by post, fax or email). The buyer can use the sample withdrawal form below, but this is not mandatory. To comply with the cancellation period, it is sufficient for the buyer to send the notification of exercising the right of cancellation before the expiry of the cancellation period. If the buyer effectively exercises this existing right of cancellation, all payments will be refunded within fourteen days at the latest from the day on which the notification of cancellation of the purchase contract was received. The refund will be made using the original payment method; no fee will be charged for the refund. The buyer has no right of withdrawal if they redeem vouchers within the withdrawal period and receive tickets for a specific date. The refund may also be refused until the Festwochen has received the vouchers already issued or has verified that no vouchers have been redeemed.

SUBSCRIPTIONS
By ordering a subscription to Meister- und Kammerkonzerte, you are entering into a contract with the Festwochen for the duration of one season. The subscription is automatically renewed for another season unless it is cancelled or changed in writing by 18 May of the current season. The Festwochen undertake to inform subscribers in good time of the possibility of cancellation, otherwise the contract will be extended. The Festwochen are also entitled to terminate the subscription contract on this date without giving reasons.

The current subscription prices apply.
Subscription cards
Subscriptions will be sent to the holders by post by August of each year at the latest.
Changes
Free transfers and cancellations of existing subscriptions can be sent by email or post to the box office at the Haus der Musik Innsbruck by 18 May of each year.
Youth subscriptions
Youth subscriptions for the Meisterkonzerte are only available in limited numbers and are non-transferable. They are subject to an age limit and must therefore be renewed annually. Appropriate photo ID must be presented when taking out these subscriptions and at each performance.
FRIENDS
Membership of the Freundeskreis der Festwochen is obtained by registering and paying an annual membership fee. The membership fee can be paid by bank transfer, payment slip, credit card or in cash. The membership year runs from 1 September to 31 August each year. Membership ends automatically at the end of the membership year without the need for cancellation. Membership can be renewed for another membership year by paying the membership fee again. The Festwochen undertakes to notify members of the renewal of their membership and of any changes to the terms and conditions in good time before the start of the new membership year. The Festwochen are entitled to refuse to renew membership without giving reasons.
The Freundeskreis membership is non-transferable and can be revoked at any time. The services associated with membership are guaranteed subject to availability. This discount cannot be combined with other discounts. By becoming a member, the member agrees to receive regular information about the Freundeskreis by email or post.
As a member of the Freundeskreis, you receive the following benefits: a 30% discount on 1 to 10 tickets, depending on your membership, and a 10% discount on all additional tickets when booking at the box office at the Haus der Musik Innsbruck or in the web shop. Further benefits: exclusive programme presentation; personal advice at the box office of the Haus der Musik Innsbruck; ticket reservations for 14 days; opportunity to participate in various activities such as rehearsal visits, receptions, artist talks, specialist lectures and guided tours (limited number of participants and additional costs in some cases); opportunity to participate in concert tours (limited number of participants and additional costs); free delivery of the programme book; free evening programmes at events.
PROGRAMME CHANGES AND CANCELLATION OF EVENTS
A published programme may be changed for compelling operational reasons. Programme and cast changes and other changes to the course of the event (e.g. short-term postponements of the start of the performance, changes to surtitles, illness of artists, etc.) do not entitle the holder to return tickets. If, in exceptional cases, an event date is postponed and/or pieces or programme items are replaced, no claim for a refund can be made. If a performance is cancelled, the admission fee will only be refunded if less than half of the performance had been shown at the time of cancellation. The right to a refund expires if it is not claimed within five days. There is no entitlement to compensation for a missed event. Information about events that have actually taken place can be found on our website www.altemusik.at.
If performances are cancelled without replacement, tickets that have already been purchased will be exchanged for replacement dates or, upon request, taken back up to seven days after the performance date. Only undamaged and original tickets will be taken back. In this case, a credit note will be issued to the customer's account or a voucher will be issued, or, at the customer's request, the amount paid will be refunded.
CESTI COMPETITION
The International Baroque Opera Singing Competition Pietro Antonio Cesti (hereinafter referred to as ‘the Competition’) is organised by the Festwochen and is aimed at young singers from all over the world with a special talent and training for the diverse field of baroque opera. Registration and payment of a participation fee are required to take part in the Competition. The winners will be selected by a jury according to the principles and procedures laid down in the rules and will receive engagements at renowned concert halls and opera houses as well as prize money. The Festwochen is entitled to make image and sound recordings of the competition events and to publish them free of charge in various media and use them for advertising purposes. The conditions of participation for the respective competition year apply.
ACCESSIBILITY
The conditions regarding accessibility of the respective event venue apply. For wheelchair users, tickets must be ordered exclusively through the box office at the Haus der Musik Innsbruck in order to ensure arrival, parking and access to the event.
PHOTOGRAPHY AND PROHIBITION OF IMAGE, FILM AND SOUND RECORDINGS
For copyright reasons, image (film, video, etc.) and/or sound recordings of performances or other events during the Festwochen are prohibited. Photography during the performance and during the final applause is not permitted. In the event of violations, the admission staff is entitled to confiscate recording devices and cameras, excluding any liability, and to retain them until the end of the performance. If necessary, the visitor may be excluded from attending the performance. Recording material of any kind on which parts of the performance are recorded will be confiscated and retained by the Festwochen and can only be returned to the owner after the recordings have been deleted. Violations may not only result in claims for damages, but are also punishable by law.
In the event that the Festwochen records or has recorded a performance or event in image and/or sound, by attending the event, the visitor agrees without restriction to the publication or use of these recordings within the usual scope, in particular for advertising purposes, without remuneration.
VIDEO SURVEILLANCE AND ACCESS SYSTEM
Visitors are informed that certain areas of the HDM building (access areas, chamber theatres and halls) are under video surveillance. Video surveillance is indicated at the respective entrances. In addition, visitors are informed that Tiroler Landestheater und Orchester GmbH Innsbruck (hereinafter referred to as ‘Tiroler Landestheater’) as the operator of the HDM and the HDM itself have viewing and listening equipment on stage and in the auditoriums and Kammerspiele.
Video surveillance takes place at the Tiroler Landestheater on stage and at the HDM in the access areas, including the corridors and auditoriums. These are recorded, stored for 72 hours, then automatically deleted and are used exclusively for the protection of persons and the prevention and investigation of criminal offences. The transfer of collected video data to third parties or the evaluation of collected video data in justified cases shall only take place to the extent necessary to achieve the above-mentioned purposes. The viewing and listening system at the HDM and in the theatre allows rehearsals and performances in the halls and on stage to be viewed and listened to. It is used exclusively for the purposes of the proper execution of events and maintenance. This data is not recorded.
Furthermore, visitors acknowledge that the HDM building has an electronic door locking system or access system. By accepting a key card, the visitor agrees to the use and subsequent utilisation of this data to the extent necessary for the fulfilment of this contract. The access data is stored for up to three months and is used exclusively for the purpose of using the building. The transfer of collected access data to third parties or the evaluation of collected access data in justified cases shall only take place to the extent necessary to achieve the above-mentioned purposes. The Tiroler Landestheater complies with the relevant data protection regulations.
DATA PROTECTION
Personal order, purchase and customer data (title, name, address, email address and telephone number) are used and stored in compliance with data protection law to the extent necessary for the initiation and execution of the contract (including processing via the Ticket Gretchen app) and for the areas of subscriptions or packages, membership of the Freundeskreis and video surveillance, as well as the access system for the respective purposes mentioned. Subject to the customer's objection, the customer will be regularly informed by email or post about events, information and news relating to the Festwochen and the Meister- und Kammerkonzerte.
Depending on the circumstances, the customer has the following rights: right to information about the personal data processed and the purpose of the processing upon request within one month (ART 15 DSGVO), right to rectification in the event of incorrect or incomplete data (ART 16 DSGVO), right to erasure (ART 17 DSGVO), right to restriction of processing (ART 18 DSGVO), right to data portability (ART 20 DSGVO), right to object to processing based on public interest or our legitimate interest (ART 21 DSGVO), right to withdraw consent (ART 7(3) DSGVO) and right to lodge a complaint with the data protection authority (ART 77 DSGVO). Consent can be revoked at any time and without justification by sending an email to festwochen@altemusik.at.
In addition to order processing, customer data will also be used for customer care and advertising purposes for the Festwochen and the Meister- und Kammerkonzerte until revoked. The transfer of data to third parties for commercial use is excluded. Please refer to our privacy policy on our website.
HOUSE RULES
The respective event venue or the Festwochen on its behalf shall exercise its domiciliary rights. The house rules of the respective event venue shall apply. The Festwochen shall be entitled to issue expulsion orders and bans or to take other appropriate measures within the scope of these domiciliary rights. In particular, visitors may be expelled from performances if they disrupt them, harass other visitors or have violated the terms of use in any other significant way or repeatedly. Admission may be refused if there is reasonable suspicion that the visitor will disrupt the performance or harass other visitors. In such cases, the ticket price will not be refunded. Visitors may only occupy the seat indicated on their ticket. If they occupy a seat for which they do not have a valid ticket, the Festwochen may charge the difference or expel the visitor from the performance. In such cases, the ticket price will not be refunded.
The private offering and resale of tickets on the premises and grounds of the event venue is prohibited.
Mobile phones, pagers and acoustic signal devices of any kind may only be taken into the audience area if they are switched off.
Food and drinks may not be taken into the audience area or consumed there.
Smoking is not permitted on the premises of the respective event venue. In the event of fire or other dangerous situations, visitors must leave the building immediately without delay via the marked exits and emergency exits. In such cases, cloakroom items will not be returned. The instructions of the staff must be followed at all times.
LIABILITY
The Festwochen is only liable for personal injury and property damage suffered by visitors on the premises of the respective event venue in cases of intent or gross negligence. Liability is excluded for property damage caused by slight negligence. Liability is otherwise excluded.
FINAL PROVISIONS
The place of jurisdiction for companies and consumers who do not have a place of residence, permanent residence or employment in Austria at the time the action is brought is the competent court in 6020 Innsbruck. Austrian law applies, excluding the referral provisions and the UN Convention on Contracts for the International Sale of Goods.
